WEEDVILLE – A 40-year-old Weedville man was placed under arrest for aggravated assault, terroristic threats and reckless endangerment after a gun incident at 9:30 p.m. Saturday in Weedville, Jay Township.
The Ridgway-based state police identified the accused as David A. Kunes Jr., 40, of Weedville. He was arraigned and placed in the Elk County Jail. His bail was set at $10,000.
According to the report, Kunes engaged in a physical altercation with the victim, a 61-year-old Weedville man. He allegedly attempted to strike the man in his face with his fist several times at which point the victim wrestled him to the ground. The victim was able to stand up and remove himself from the altercation.
Kunes then retreated inside his residence where he retrieved a Springfield Armory M1 Garand rifle. He allegedly pointed the rifle at the victim who was standing in front of his residence along Apple Street.
Kunes fired one round at the victim and missed, and the bullet impacted approximately 11 feet to the rear of where the victim was standing. A nephew of Kunes, a known 16-year-old boy, tackled Kunes to the ground, police said.
The victim approached both Kunes and the boy, and he and the boy both attempted to disarm Kunes when the gun discharged again. The bullet impacted the roadway approximately 10 feet from the altercation.
