Two Accused of Sexual Assault Waive Hearings

CLEARFIELD – Two men who have been accused of sexual assault in separate cases waived their right to a preliminary hearing Wednesday at Centralized Court at the Clearfield County Jail.

Daniel Lee Hubler, 19 of Curwensville, will face 10 counts each of statutory sexual assault, aggravated indecent assault and indecent assault.

Clifford Lee Daub, 24 of Clearfield, will face two counts each of statutory sexual assault, aggravated indecent assault and indecent assault.

Both Hubler and Daub had their bail set at $20,000 unsecured.

According to the affidavit of probable cause in the Hubler case, on Aug. 14 the Clearfield County Children, Youth and Family Services made a referral to the Clearfield Borough Police Department and alleged that a 14-year-old victim had sexual intercourse with an older, known male.

On Sept. 5, police met with the victim and her mother and advised them of the allegations. They stated the victim advised that sometime after July, she began to date Hubler. She said the two had sexual intercourse more than 10 times but less than 20 times.

On Sept. 9, police advised Hubler of the referral alleged by the CYS. They stated that in the referral, it alleged he had sexual intercourse with the victim. They stated Hubler told them he had sexual intercourse more than 10 times but less than 20 times with the victim.

Police indicated that the acts occurred at various locations and at times inside a tent at a Williams Street address in Clearfield. They stated that Hubler told them he knew the victim’s age at the time. They indicated that Hubler said he used protection during the act, which he also said was consensual.

According to the affidavit of probable cause in the Daub case, on Aug. 14 the CYS made a referral to the CBPD and alleged that a 13-year-old victim and the previous 14-year-old victim had sexual intercourse with an older male.

Police stated that on Sept. 5, they met with both victims and their mother and advised them of the allegation.

Police stated the 13-year-old victim advised she and Daub had sexual intercourse once in a tent in the back yard of a Williams Street address.

Police stated that the 14-year-old victim also advised she and Daub had sexual intercourse once in a tent in the back yard at the same aforementioned address.

On Sept. 8, police met with Daub about the incident. They told the defendant that the CYS had made a referral. They advised him that in the referral, the CYS alleged he had sexual intercourse with the victims.

According to the affidavit of probable cause in the Daub case, the defendant told police that in late July, he had sexual intercourse with the 13-year-old victim in a tent in the back yard of a Williams Street address.

They said Daub told them that the encounter was consensual, and he used protection during the act. They said he also indicated to police he was “fully aware” of the victim’s age at the time. They stated that Daub told them the intercourse only occurred one time.

Police said Daub further related that approximately one month prior to the previous incident, he had sexual intercourse with the 14-year-old victim in a tent in the back yard at a Williams Street address. They said he told police the intercourse was consensual, and he used protection during the act. They said he again related he was “fully aware” of the victim’s age at the time. They said he stated the intercourse only occurred one time.

Police stated Daub also said that during the encounters, he and the victims did not engage in oral or anal sex.
