DUBOIS – A DuBois man accused of fleeing from police waived his right to a preliminary hearing on Friday.
Eric Smith, 21, is charged with driving under the influence, fleeing or attempting to elude police, obedience to traffic control, resisting arrest, reckless driving and related charges.
According to the affidavit of probable cause, Smith was viewed making an illegal left turn from North Brady Street onto West Park Avenue. The truck nearly struck a patrol vehicle and Smith allegedly looked directly at the officer.
The officer activated his lights and siren and pursued Smith who led him on a chase, eventually stopping on High Street. Smith was reported to have led the officer on a foot chase then. When the officer eventually found Smith, he was hiding behind a staircase with his hands in his pockets. According to documents Smith did not directly comply with police orders and was taken down, and after a brief struggle, taken into custody.
Once in custody Smith did not give the officer his name. The officer had to locate his wallet to find out Smith’s name.
