Vancouver, BC, United States (NewsBahn) – Winnipeg Jets forward Evander Kane is accused of an assault that allegedly took place in Vancouver last summer.
Lev Makievsky is seeking financial damages of an unknown amount after claiming he was jumped by Kane while walking in the area of Burrard Street and Barclay Street in August.
The man says he has injuries all over his body from the alleged incident and suffers headaches, dizziness, nausea, fatigue and insomnia.
“The injuries have and will continue to cause him suffering, loss of enjoyment of life, permanent physical disability, loss of earning capacity and loss of housekeeping capacity,” his lawsuit reportedly reads.
Officials say they will not press the matter further, however, after conducting an initial investigation.
“We did investigate allegations of an assault on that day and at that location, but given the circumstances of the incident there were no arrests made and there was insufficient evidence to support or recommend any criminal charges,” Const. Brian Montague told the Free Press on Wednesday. “From our perspective, the matter is considered closed.”
Kane can countersue Makievsky if he considers the claim to be frivolous or malicious.
He has 30 days to file a statement of defence over the matter.
