TiVo Wins Infringement Case Against Dish Network, EchoStar

Alviso, CA, United States (AHN) – The U.S. Court of Appeals for the Federal Circuit ruled in favor of TiVo Inc. on Thursday in a second infringement case that claimed Dish Network and EchoStar continued to infringe on TiVo patents.
The ruling upholds a decision made by a lower court that the two satellite television providers are still infringing on TiVo (NSDQ: TIVO) patents with their digital recording devices.
Dish Network had lost an infringement suit with TiVo in 2006, at which point Dish was ordered to redesign its digital recording software so that it was no longer in violation of the patents. The appeals court found the changes did not constitute a major redesign.
“We are pleased that the United States Court of Appeals for the Federal Circuit fully affirmed the district court’s finding of contempt against EchoStar, including both the disablement and infringement provisions.” TiVo said in a statement.
“Additionally, this ruling paves the way for TiVo to receive the approximately $300M in damages and contempt sanctions awarded to us for EchoStar’s continued infringement through July 1, 2009. We will also seek further damages and contempt sanctions for the period of continued infringement thereafter. We will continue our efforts to protect our intellectual property from further infringement.”
Shares of TiVo surged on the announcement, trading 56 percent higher to $15.98 in late afternoon action.
