CLEARFIELD – A Curwensville man decided against having a hearing on three cases, two of which involve allegedly selling drugs to a confidential police informant.
Fred D. Harvey was before Magisterial District Judge James Hawkins Wednesday for the cases, investigated by the state police.
Harvey opted against hearing the evidence against him. If he had chosen to move ahead with the hearing, Judge Hawkins would have ruled on whether it was likely that a crime was committed and whether it was likely that Harvey committed it. Because he waived the right to a hearing, the charges were automatically moved to court where Harvey will have to enter a guilty plea or proceed to trial.
The investigation into Harvey began in November when a confidential informant called the state police to tell them that Harvey was willing to sell marijuana. Court documents allege that Harvey sold the drugs to an undercover police officer.
In January, Harvey allegedly sold to the same officer again. Samples from both bags tested positive as marijuana.
Two days after the second purchase, troopers served a search warrant at Harvey’s home, seizing a total of 21 items from the house. Those items included marijuana, prescription drugs, drug paraphernalia and several guns.
Judge Hawkins set bail on each case at $25,000 straight.
Harvey is charged with unlawful delivery of a controlled substance and other counts.
